JIM COOGAN DISCUSSES GUN MANUFACTURER LIABILITY AND THE LAW WITH BEN JORAVSKY (December 6, 2017)
Our Jim Coogan joined The Ben Joravsky Show on WCPT AM 820 Radio in Chicago (wcpt820.com) to discuss the Soto v. Bushmaster International Firearms, et al. case. In the case, the families of children and teachers killed at Sandy Hook Elementary School in Newtown, Connecticut sued Remington (manufacturer of the Bushmaster firearm used by the shooter in Newtown) and Camfour (a distributor of the weapon) for negligence and products liability for the losses. The Connecticut State Court judge who heard the case dismissed it pursuant to the Protection of Lawful Commerce in Arms Act. Jim and Ben discussed the origins of the law, which was enacted in 2005 to protect handgun and gun manufacturers from the liability for losses resulting from criminal or unlawful use of their guns. The case recently went up to the Connecticut Supreme Court where the parties argued about whether the case should be barred by the Federal law. A decision is pending.
